These Terms of Service ("Terms") govern your access to and use of the DripVivo mobile application and website (collectively, the "Service"), operated by DripVivo ("we", "us", or "our"). By creating an account or using the Service in any way, you agree to be bound by these Terms. If you do not agree, do not use the Service.
You must be at least 13 years old to use DripVivo. By using the Service, you represent that you are 13 or older. If you are between 13 and 18 years old, you may only use the Service with the consent of a parent or legal guardian who agrees to these Terms on your behalf.
To access most features of DripVivo, you must create an account. You agree to:
You may not create an account on behalf of someone else without their explicit permission, or impersonate any person or entity.
You retain all ownership rights in the content you create and post on DripVivo ("User Content"). We do not claim ownership over your content.
By posting User Content, you grant DripVivo a non-exclusive, worldwide, royalty-free, sublicensable licence to host, store, display, reproduce, distribute, and make available your content solely for the purpose of operating and improving the Service. This licence ends when you delete your content or your account.
You are solely responsible for your User Content and the consequences of posting it. You represent and warrant that:

We reserve the right to remove any content and suspend or terminate any account that violates these rules, at our sole discretion.
The DripVivo name, logo, app design, and all related trademarks, service marks, and trade names are the exclusive property of DripVivo. You may not use them without our prior written consent. All other content on the Service not owned by users is owned by or licensed to DripVivo.
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review it to understand our data practices.
The Service may contain links to or integrations with third-party websites or services (for example, social media platforms for sharing). We are not responsible for the content, policies, or practices of any third-party service. Your use of third-party services is at your own risk and subject to their terms.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DRIPVIVO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED £100 OR THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, WHICHEVER IS GREATER.
You agree to indemnify and hold harmless DripVivo and its officers, directors, employees, and agents from any claims, losses, damages, liabilities, and costs (including legal fees) arising out of your use of the Service, your User Content, or your violation of these Terms.
We may suspend or terminate your account at any time, with or without notice, for violation of these Terms or for any other reason at our sole discretion. You may delete your account at any time through the app settings. Upon termination, your licence to use the Service ends immediately.
We may update these Terms from time to time. We will notify you of material changes by posting a notice in the app or sending an email to the address associated with your account. Your continued use of the Service after the effective date of the updated Terms constitutes your acceptance of them.
These Terms are governed by the laws of England and Wales. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales, unless you are a consumer resident in another country, in which case your local consumer protection laws may also apply.
